Nintendo Takes Strong Action Against 200,000-Member Reddit Community SwitchPirates Amidst Legal Battle

In a bold move to safeguard its intellectual property, Nintendo is ramping up its legal actions against the popular subreddit SwitchPirates, which boasts a staggering 200,000 members. This comes as the Japanese gaming giant predicts net sales of $8.4 billion and operating profits of $2.4 billion for 2024, a continuation of its aggressive stance against modding and game emulation.

According to reports from Game File, this latest legal action is an extension of Nintendo's existing case against James “Archbox” Williams, the moderator of SwitchPirates. The company claims it has uncovered a network of individuals linked to alleged piracy activities and seeks detailed information from a range of tech firms, including Reddit, Cloudflare, Discord, GitHub, and Google, to pinpoint those involved in the alleged illegal activities.

Nintendo's legal filings reveal that following the closure of Modded Hardware—an online site associated with Archbox—the company is determined to trace other suspects that contributed to these so-called "Pirate Shops." This extensive effort includes subpoenas that would grant Nintendo access to account details and payment sources connected to the subreddit members, potentially revealing the identities of those behind the moderation and organization of these illicit activities.

The court documents state, "We learned that the Defendant was active in numerous Discord servers related to the Pirate Shops" and indicates that Archbox played a pivotal role in multiple capacities within the community. Despite initial attempts to name other potential defendants, Nintendo claims that the ongoing evasion of services by Archbox has complicated their investigation, prompting the need for further subpoenas.

Asking for specific data retention from Google, Nintendo insists on gaining insights into drive and email communications, which they believe could shed light on the operations within the subreddit. The company emphasizes that the nature of its subpoenas will be "limited in scope" and aimed solely at identifying account holders and their respective online activities.

With over 146 million Nintendo Switch consoles sold, making it the third-best-selling console in history, it seems Nintendo is leaving no stone unturned in combating piracy. The company is expected to surpass the Nintendo DS—currently in second place—within the year as it remains vigilant against threats to its brand and revenue.
